- US customs & car importation into Canada
Q: Is there any US export rules?
A: My understanding is that US Customs does indeed
expect anyone planning to export a vehicle for
permanent use outside the US to stop at a US
Customs office =before= leaving the US, in order
to allow inspection of the vehicle and its title.
Presumably, this is an attempt to curb the smuggling
of stolen vehicles out of the US by checking the
VIN number against police records. Anyone
who has ever driven over the US/Canadian border,
of course, can appreciate how utterly stupid any such
rule is -- but that's another matter.
At one time, the regulation (Title 19, Part 192 of the Code of Federal
Regulations -- 19 CFR 192) required either the original vehicle title,
or a notarized copy thereof, to be delivered to the US Customs office
at the border crossing point, early enough to arrive at least 72 hours
in advance of the planned export of the vehicle. I don't know if this
is still required; I've read accounts spanning the spectrum from "you
can send a fax", to "just show us the title when you show up", to "you
want us to check what??? go away!".
In 1992, as I was preparing to immigrate to Canada from the US, I went
through a major hassle. At first, the moving company refused to believe
this rule existed. Then, they insisted they had no way of assuring me
in advance of exactly what route the van driver would take (and thus
which US Customs office I should send a notarized copy of the vehicle
title to). They did finally agree to give me this info the day after
our stuff (including the car) was loaded onto the van. But when I met
the van driver at our destination, he said he hadn't bothered to stop
at US Customs on his way across the border (!). Canada Customs didn't
even blink an eye when I failed to show them any export approval for
the car from US Customs. I wrote US Customs and was advised that they
did not consider me liable for any violations (I never found out whether
the moving company got in trouble or not, though).

Q: If I have a Canadian Green Card, do I need a U.S. visa to enter the
U.S. for short term visit ?
A: In the world of immigration, "Green Card", is a US term,
and it is not used in Canada.
I suppose you're asking that if you hold permanent
resident status in Canada, do you need a visa to visit
the US.
The answer is "maybe". It depends on your citizenship.
If you are a citizen of a country in the the Commonwealth
of Nations, also known as the British Commonwealth, or
Ireland, then as a permanent resident of Canada
you can visit the US without a visa.
Alternatively, citizens of certain countries can enter the
US without a visa under the US Visa Waiver Pilot Program.
You do not have to be a permanent resident of Canada
to use this program. A list of the eligible countries
can be found at

If you are not eligible to enter under the exemption
for permanent residents who are Commonwealth
citizens, or under the visa waiver, then you must
have a US visitor visa in order to visit the US.

Q: I got my PR almost 3 years ago, and I have always lived and
worked in Canada since, but for brief vacations. Now I would like to
hunting for jobs in the USA but I do not know whether it is possible.
Also, I will have a Canadian citizenship in few months, will this
change anything?
A: First you have to find an employer who will sponsor your work permit
application in the USA. You will be treated like any other alien regardless
of your PR status in Canada. After you become Canadian citizen you will be
able to take advantage of NAFTA if your occupation is on the NAFTA list for
TN visas.

- American Green Card holder visits Canada
Q: I have had US green card for 11 months. I am in US. My question is : How
many times I can go to visit my friends in Canada and for how long?
A: Green Card holders in the USA may appear at a Canadian port of entry
without obtaining a passport visa. At the port of entry, an immigration
official will determine admissibility and the allowed duration based on
discretion. The maximum stay for a visitor without special permission is
generally 6 months.
